General Terms and Conditions (GTC) for the car rental company Ju-Rentals
This english translation of these GTC is for information purposes only. 

Only the German version is legally effective. 

§ 1 Scope of application
1. These General Terms and Conditions (GTC) apply to all rental contracts concluded between Ju-Rentals (hereinafter referred to as the “ lessor”) and the renter.
2. Deviating terms and conditions of the renter shall only apply if the lessor has expressly agreed to them in writing.

§ 2 Rental object
1. The lessor shall provide the renter with a used vehicle.
2. The vehicle may have a relatively high mileage and may show clear signs of use, but is technically flawless, regularly serviced and inspected annually as part of the statutory main inspection in accordance with § 29 StVZO. 

§ 3 Conclusion of contract and rental period
1.The rental contract is concluded as soon as the renter takes over the vehicle and signs the rental contract.
2. The rental period is specified in the contract. If no end to the rental period is specified, the term is automatically extended by the specified period.
3. The following notice periods apply:
- Rental period of one week: 2 working days to the end of the term.
- Rental period of one month or more: 5 working days to the end of the term.


§ 4 Rental price and payment
1. The rental price is based on the current price list or the amount agreed in the contract.
2. The rental price must be paid in cash or by bank transfer in advance when the vehicle is handed over, unless otherwise agreed.
3. additional costs (e.g. for fuel, damage or cleaning fees) will be charged separately.

§ 5 Vehicle handover and return
1. The renter is obliged to check the vehicle for defects when taking it over and to report these to the lessor. Subsequent complaints about obvious defects are excluded.
2. The vehicle must be returned in a condition that corresponds to the rental period and normal use.
3. The vehicle is handed over with a full tank of fuel and must be returned with a full tank. If the vehicle is not refueled, a service fee of 20 euros plus fuel costs will be charged. 

§ 6 Obligations of the renter
1. The renter is liable for all damage to the vehicle during the rental period, insofar as this is not caused by normal wear and tear or technical defects.
2. The renter is obliged to inform the lessor of any change of address or relocation.
3. The renter is liable for traffic violations and fines incurred during the rental period.
4. The renter must treat the vehicle with care and comply with all applicable traffic regulations.
5. The renter must inform the lessor immediately of any damage or technical defects.
6. There is no smoking in all rental cars. 

§ 7 Obligations of the Lessor
1. The Lessor shall only be liable for damage caused by gross negligence or intent.
2. Liability for technical defects caused by the age or mileage of the vehicle is excluded. There is no entitlement to compensation. 
3. The lessor will not pass on any personal data to third parties. Unless a regulatory authority requests it in order to determine the perpetrator of warnings, administrative offenses or criminal offenses. 

§ 8 Insurance cover
1. The vehicle is covered by liability insurance with LVM Versicherung.
2. This insurance is liable with € 100 million lump sum / € 15 million per person / environmental damage insurancen: € 5 million per loss event, max. € 10 million per year. 
The renter is liable for costs exceeding this amount. 
3. The renter is liable for damage to the rental vehicle up to the value of the vehicle at the time before the damage occurred, up to a maximum of €2000.
4. the vehicle is covered by an insurance policy with LVM Versicherung. In the event of a breakdown or accident, assistance will be organized on request and the costs of restoring the vehicle to running order or towing up to 200 euros and unlimited recovery costs will be covered. There is a flyer in the glove box of the vehicle with all the cover services, conditions and important telephone numbers. The renter may be required to make an advance payment. The lessor is not liable for the repayment.

§ 9 Termination and withdrawal
1. the lessor is entitled to terminate the rental contract without notice in the event of gross violations by the lessee (e.g. drinking and driving, disregard of the general terms and conditions) and to collect the vehicle without the knowledge or consent of the lessee. 
2. the Hirer may withdraw from the contract, but may have to pay a cancellation fee if this is not done at least 24 hours before the start of the rental period.

§ 10 Final provisions
1. German law shall apply. The place of jurisdiction is Dülmen.
2. should a provision of these GTC be invalid, the remainder of the contract shall remain valid. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
